Cardoe Martin can be called upon to provide Expert Witness Reports for court cases and legal disputes.

Our services are typically required to resolve disputes between a landlord and tenant which may have escalated to requiring a legal resolution, or where a property owner is in dispute with a contractor over the standard of works carried out.

We may be asked to provide impartial testimony within the remit of our role as an expert witness, which may be on behalf of either individual in the dispute or as a Single Joint Expert for both parties.

Cardoe Martin have extensive experience acting in such matters, applying our technical expertise to complex disputes and providing comprehensive reporting to aid the dispute resolution process.

Similarly, where we have been appointed by a court, the report we submit can be used to form the framework for an agreement between two parties in the pre-court communications.

In both instances, if no resolution is reached then we will act on our client’s behalf in the court room.

The majority of disputes revolve around matters of building disrepair and assessment of issues. We have also attended to many involving qualities of a contractor’s works.

What are the duties of an expert witness?

According to RICS, an expert witness must, ‘give an opinion based on experience, knowledge and expertise. The overriding duty of an expert witness is to provide independent, impartial and unbiased evidence to the court or tribunal.’
